Selling a house in probate in New York follows a defined legal path. The property cannot be sold until the Surrogate's Court appoints someone with authority, but almost everything else — pricing, preparation, and marketing — can happen in parallel to save months.

Step 1 — Open the Estate in Surrogate's Court

Step 2 — Obtain Letters Testamentary

Only after the court issues Letters Testamentary (or Letters of Administration) does anyone have legal authority to sign a deed. In uncontested cases this takes roughly six weeks to three months.

Step 3 — Value, Prepare, and List

Get a current market valuation (which also sets the stepped-up basis), clear the property, resolve title and liens, and list. You can market the home while Letters are pending and accept offers subject to closing conditions.

Step 4 — Accept an Offer and Close

The executor reviews offers, signs the contract, and closes once Letters are in hand. Proceeds pay estate debts and taxes, and the remainder is distributed to beneficiaries. Many executors compare a fast cash sale against a traditional listing.
